The laws in Florida are very explicit when it comes to helmet requirements for motorcyclists.

  • All motorcycle drivers are required to wear protective eyewear and helmets, which must meet the U.S. Department of Transportation requirements.
  • Only motorcyclists aged 21 years or older can opt not to wear a helmet, but only if they are adequately insured.
  • To lawfully operate a motorcycle, a person under the age of 21 must wear both a helmet and eyewear. Not wearing either one is not an option.

Passenger restrictions also exist under Florida’s motorcycle laws.

  • Passengers under age 21 must also adhere to the law and always wear a helmet and eyewear, with no exceptions.
  • Only passengers ages 21 and over can choose not to wear a helmet. This is allowed only if the passenger is insured with coverage to include medical benefits in the event of injuries sustained in a collision.
  • While traveling on public roads, streets, and highways, passengers are required by Florida law to wear U.S. Department of Transportation-approved protective eyewear.
